New Delhi, May 6, 2024: The Supreme Court on Monday dismissed a contempt petition filed by 30 women army officers. The petition alleged that a special selection board that considered their promotion in January had violated the court's November 2023 order, which required them to be considered by a panel independent of those who had been previously shortlisted for promotion.

The petitioners had accused the army of discriminating against them in promotion to the rank of colonel. A bench of Chief Justice D.Y. Chandrachud and Justices J.B. Pardiwala and Manoj Mishra said they were satisfied that there was no violation of the order. "This is not a contempt case.

Their (Army's) case is that benchmarking was considered for assessing the merit of the officers who were part of the panel. It was our own order that those who were already shortlisted for promotion should not be disturbed, but that order is not to prevent the Army from benchmarking," the bench said.

The court said that the Army had followed the procedure laid down by it and that there was no basis for the petitioners' grievance.

"The Army has considered the petitioners' case fairly and in accordance with the law," the bench said.
