The Supreme Court of India overturned a Madras High Court ruling that held watching child pornography in private was not a crime under the POCSO Act. The SC clarified that even possessing such material with certain intent constitutes an offense under Section 15 of the POCSO Act.

The Court also recommended using the term "Child Sexual Exploitative and Abuse Material" (CSEAM) instead of "child pornography" in judicial orders. The ruling emphasized the gravity of child exploitation, even without distribution or transmission.
