The Supreme Court of India recently affirmed that daughters have a legally enforceable right to secure educational expenses from their parents. In a matrimonial dispute involving an estranged couple, the Court upheld the daughter's entitlement to ₹43 lakh for her studies in Ireland, emphasizing that parents can be compelled to provide necessary funds for their children's education within their financial means.
The case was presided over by a bench comprising Justices Surya Kant and Ujjal Bhuyan. The daughter had initially refused the ₹43 lakh offered by her father, aiming to maintain her dignity. However, the Court clarified that she is legally entitled to retain the amount for her educational needs. citeturn0search4
Additionally, the Court referred to a settlement agreement dated November 28, 2024, in which the father agreed to pay a total of ₹73 lakh—₹43 lakh for the daughter's education and ₹30 lakh for the estranged wife. Noting that the couple had been living separately for 26 years, the Court dissolved the marriage by mutual consent under Article 142 of the Constitution.
The court clarified that the daughter is not obligated to return the money and may use it as she deems appropriate.
