The Allahabad High Court recently ordered a law college in Gorakhpur to pay Rs 5,00,000 in compensation to a student whose admission was wrongfully canceled due to the institution's negligence. The case involved Ajay Kumar Pandey, who had been admitted to the college and completed his first semester before his results were voided after the university found his admission violated the 2019-20 eligibility rules.
A division bench of Justices Vikas Budhwar and Manoj Kumar Gupta ruled that the Prabha Devi Bhagwati Prasad Vidhi Mahavidyalaya acted recklessly by admitting Pandey without properly verifying his eligibility. According to the 2019-20 academic guidelines, students were required to have obtained their graduation degree from 2016 or later, while Pandey's degree was from 2008. This error was only discovered after Pandey completed his first semester, leading to the cancellation of his admission in January 2021.
Pandey filed multiple petitions challenging the cancellation, but his appeal was initially dismissed by a single-judge bench in August 2024. However, the High Court ruled that the compensation awarded earlier, which included a refund of fees amounting to Rs 30,000, was inadequate given the harm done to Pandey’s academic future. The court criticized the law college for its careless admission practices and noted that the institution admitted its fault, acknowledging that 54 other students were similarly affected.
In its ruling, the High Court increased the compensation to Rs 5,00,000, highlighting that the negligence of the law college had significantly jeopardized Pandey's career. The court ordered that if the compensation is not paid within six weeks, it will be recovered as arrears of land revenue.
